Welcome to the terms and conditions page. Now if you are planning on reading this and you are anything like us we recommend you grab a pillow before you start. This stuff puts most people to sleep faster than a box of valium at a church service. Having said that though, our Legal friends tell us, that in the modern world of internet commerce we have too have it. We told them just because we have it doesn’t mean we have to read it. So we left that part up to you and them, if that’s what floats your boat. For the purposes of these terms and conditions, any reference to Slap the Goon also implies reference to Agent Styles Pty Ltd, trading online through www.slapthegoon.com

PRIVACY POLICY

Please review the Slap the Goon Privacy Policy in the FAQs. There is additional and qualified information with regard to the act of information exchange. This notice is to inform you about the policies for collection and use of personally identifiable information on the Agent Styles, and Slap the Goon network of websites. Other websites which are linked to our site may have different policies. Please review the privacy policy notices on those sites for details.

COLLECTION OF INFOMATION

We do not collect personally identifiable information about you on this site without your knowledge, and all such information is collected directly from you. For example, we may ask you to provide your e-mail address, name, mailing address, or other information about yourself in order to participate in contests, chat rooms, or on bulletin boards, to be added to the list to receive e-mail updates on particular events, promotions, newsletters, to send e-cards or to conduct other transactions on the site. You are not required to provide us with this information but, if you choose not to, you may not be able to participate in some of the activities on this site. If you are under thirteen (13) years old, you should only submit information about yourself with the consent of a parent or guardian.

USE AND DISCLOSURE OF INFORMATION

We use the information we collect from you to allow you to participate in the site activities. For example, if you give us your e-mail address to receive The Goon Times news letter or to receive product updates, that address is added to the e-mail list for slapthegoon.com. On each e-mail you receive, you are given the opportunity to unsubscribe, and in some cases, to change your preferences. When you unsubscribe, we remove your e-mail address permanently from that mailing list.
For competitions conducted on this site, we use the personal information you provide for the purpose of contacting you if you win a prize and sending the prize to you. We do not use contact information contained in competition entries for any purpose other than as expressly stated in the competition terms and conditions. For further information about how we handle entries to a particular contest, please consult the contest rules. We do not share personal information provided by site visitors with anyone outside of Slap the Goon and companies in the Agent Styles Group of online web sites in Australia and overseas, except to the extent necessary to allow you to participate in site activities (for example, to send you a prize that you have won in a contest on the site) or where Agent Styles is acting as agent for third parties with whom you are transacting. We occasionally hold promotions in conjunction with other companies. In this instance we offer you the opportunity to be contacted by our promotions partner. We will not give your details to the promotions partner unless you have opted in.
If Slap the Goon shares your information with service providers, agents or contractors we require these parties to protect your information in the same way we do.

We try to keep the information we collect from you as current as possible, and we take steps to maintain the security of your personal information and to prevent unauthorised access to it by those who do not have a legitimate need for it. Generally, we will not post your e-mail address or other identifying information you have provided on our site without your consent. This consent may be express or implied.
You have a right to access most of the information held about you by slapthegoon.com, and also the ability to correct or update any of this information held about you by slapthegoon.com at any time. 1. Your Acceptance of Terms and Conditions
The slapthegoon.com websites is owned and operated by Agent styles Pty Ltd trading online as slapthegoon.com. Your access to the Slap the Goon sites is conditional upon your acceptance of, agreement to and compliance with the terms, conditions, notices and disclaimers, including the Slap the Goon Online Privacy Policy, contained here and elsewhere on the Slap the Goon sites (together, the “Terms and Conditions”). Your use of and access to the Slap the goon site constitutes your agreement to the Terms and Conditions. Agent Styles and Slap the Goon reserve the right to amend, update or change the Terms and Conditions at any time without prior notice and you should periodically refer to them.

2. Intellectual Property in Content on the Slap the Goon website.
The content of the Slap the Goon site (including copyright works, text, material, software, images, graphics, advertisements, databases, sound recordings, cinematograph films, animation, downloads, e-cards, streaming audio and streaming video)(together, “Content”) is copyright © AGENT STYLES PTY LTD and/or its licensors. All Rights Reserved. You must not modify, adapt, copy, reproduce, decompile, communicate, transmit, make available, broadcast, perform, store, republish, print, commercialise, frame, upload or otherwise distribute the Content in any way except as expressly permitted on the Slap the Goon site. Provided that you keep all content intact and in the same form as made available by Slap the Goon on the Slap the Goon site, you may, using an industry-standard web browser, temporarily download and view the content for your personal, non-commercial use but only in the course of browsing the Slap the Goon site. Otherwise no part of the content of this site may be reproduced in any form without the written consent of Agent Styles Pty Ltd. All rights not expressly granted are reserved by Agent Styles Pty Ltd. You must not use any of Slap the Goons trade marks for any purpose without express consent from Agent Styles Pty Ltd.

4. User License and Consent
By submitting, posting or placing any information or other material on the Slap the Goon site (together, “Material”) or accessing the Slap the Goon site, you grant to Slap the Goon a perpetual, royalty-free, non-exclusive, irrevocable, unrestricted, worldwide license to do the following in respect of the Material:
• use, copy, reproduce, adapt, communicate, transmit, broadcast make available, publish, print, publicly perform or display; and
• Sublicense to any person the unrestricted right to exercise any of these rights.
You warrant that the Material and its use does not infringe any copyright, trade mark, patent, design, privacy, confidentiality or any right of any party or any law. You indemnify Slap the Goon and any of its assignees or licensees from any claim, liability, loss or damage arising in respect of your breach or alleged breach of this warranty. You will procure that any author of Material, unconditionally and irrevocably, to the fullest extent permitted by law (i) waives in favour of Slap the Goon and its licensees and their assigns all of the author’s moral rights; and (ii) consents to any and all acts or omissions of Slap the Goon and its Licensees and their assigns which would, but for this consent, infringe any of the author’s moral rights, in relation to all forms of works and other copyright subject matter (both existing and future) howsoever arising anywhere in the world in connection with the Material and its use. Where the law requires Slap the Goon and its Licensees and their assigns to specify acts or omissions (or specified classes or types of acts or omissions) to which the author consents, you will procure the author’s consent to the following with respect to the Material:
(a) alteration of size, colour and shape; (b) editing and adaptation, including use with other materials and the overlay or superimposition of other materials; (c) digitisation, including communication to the public; and (d) non-attribution of the author. If Slap the Goon requests, you shall execute and deliver to Slap the Goon any instruments or documents which Slap the Goon believes are required to carry out any license, waiver or consent. Any personal information collected on the Slap the Goon site will be handled in accordance with the Slap the Goon Online Privacy Policy.

5. Use of the Slap the Goon Website
The Slap the Goon site may contain one or more bulletin board, chat forum or other communication facility (”Forum”). By using and accessing the Slap the Goon site or a Forum, you agree that you will not do any of the following:
• post, communicate or transmit any unlawful, criminal, threatening, abusive, contemptuous, or indecent Material;
• post, communicate or transmit Material which violates or infringes the rights of any other person or party or infringes any law;
• inhibit or restrict any other user from using the Slap the Goon Website;

It is your sole responsibility to be aware of the lawfulness of the Material. You acknowledge that all Forum communications are public and not private communications. Slap the Goon reserves the right to cooperate fully with any law enforcement authority in any jurisdiction in respect of any lawful direction or request to disclose the identity or other information in respect of anyone (including you) posting material which violate or allegedly violate any law. Slap the Goon reserves the right to remove without prior notice any posting of Material for any reason in Slap the Goons absolute and sole discretion but is not obliged to do so. You agree and acknowledge that:
• Slap the Goon is not responsible for any content or material in any Forum (including, without limitation, any information, comments and/or advice of any individual or party referred to as a guest or expert whose statements on a Forum are their own);
• Slap the Goon does not authorise or endorse the comments or material of users of the Slap the Goon site or Forum.
• Slap the Goon may use your personal information that is collected on the Slap the Goon Site or Forum for the purposes specified in these Terms and Conditions and will handle this personal information in accordance with the Slap the Goon Online Privacy Policy.

6. Linking to the Slap the Goon Website
You must not link to the Slap the Goon website without first obtaining the prior consent of Slap the Goon. This is consent from a director or secretary of Agent Styles Pty Ltd, who trade online thru slapthegoon.com

7. Third Party Websites
The Slap the Goon website may contain links or references to Internet websites operated by third parties (”Third Party Sites”). Slap the Goon provides these links as a courtesy and this should not be interpreted in any way as an endorsement of any Third Party Site. Third Party Sites are not under the control of Slap the Goon and Slap the Goon is not responsible for the content of any Third Party Site. Slap the Goon makes no representations or warranties and accepts no responsibility for the accuracy, completeness, content or use of the information accessible from Third Party Sites.

8. Termination
These Terms and Conditions are effective until terminated by Slap the Goon and Slap the Goon may terminate this agreement and/or your access or membership to the Slap the Goon website at any time without prior notice to you. In the event that Slap the Goon terminates your access to the Slap the Goon website, you are no longer authorised to access the Slap the Goon website, however, all restrictions imposed on you, licenses granted by you and all Slap the Goon’s disclaimers and limitations of liability contained in the Terms and Conditions will survive termination.

9. Disclaimer and Limitation of Liability
Slap the Goon does not exclude any rights and remedies in respect of goods or services under the Trade Practices Act 1974 (Cth) which cannot be excluded, restricted or modified. However, Slap the Goon does exclude all other rights, remedies, conditions and warranties in respect of goods, services and the Slap the Goon website arising under custom, law or statute which may be excluded. To the fullest extent permitted by law,
• Slap the Goon makes no warranties, either express or implied, regarding the Slap the Goon website, the content or any goods or services including, but not limited to, implied warranties of merchantability or fitness for a particular purpose. Slap the Goon does not warrant that your access to the Slap the Goon website, the delivery of the Slap the Goon website or the content shall be free from errors, defects, bugs or viruses, uninterrupted, or reparable if damaged or impaired.
• Slap the Goon will not be liable for any indirect, incidental, special, punitive and/or consequential damages, loss of profits and/or income, loss of data, loss of use, claims of third parties, or other losses of any kind which result from any use or access of, or any inability to use or access, the Slap the Goon website or any content, or any product or service, even if Slap the Goon has been advised of the possibility of such damages or losses.
• Slap the Goons liability in respect of any product or service purchased from the Slap the Goon website is limited to the less of (i) the replacement of any product or service purchased; and (ii) the purchase price paid by you to Slap the Goon for that product or service.
• Slap the Goon is not liable to you or anyone else in respect of any interference with or damage to your computer system or any other device which occurs in connection with your use of the Slap the Goon website or a Third Party Site.

10. Indemnity
You indemnify Slap the Goon, its licensees and/or assignees in respect of any claims, loss, damage or costs (including legal costs on a full indemnity basis) arising from or in connection with any breach or alleged breach by you of these Terms and Conditions or any other legal obligation.

11. Waiver
Slap the Goons failure to exercise or enforce any one or more of its rights under these Terms and Conditions will not constitute a waiver of its rights.

12. Severability
If any part of these Terms and Conditions are or become illegal, invalid or unenforceable in any relevant jurisdiction, the legality, validity or enforceability of the remainder of these Terms and Conditions will not be affected and these Terms and Conditions will be read as if the part had been deleted in that jurisdiction only.

13. Rights and Remedies Cumulative
Slap the Goons remedies and rights are cumulative and none of them limits any other remedy or right of Slap the Goon. Your undertakings and obligations are cumulative and none of them limits any other of your undertakings or obligations.

14. Assignment
Slap the Goon may assign its rights in whole or in part to any person in Slap the Goons absolute discretion.

15. Governing Law
These Terms and Conditions will be governed and interpreted in accordance with laws of the State of New South Wales, Australia and the parties submit to the non-exclusive jurisdiction of the courts of that State.

16. Application to Wireless Access
For the avoidance of doubt, these Terms and Conditions equally apply to the use of the Slap the Goon website (including access to Content and the purchase of Slap the Goon goods and/or services) by wireless means, including mobile telephone and other devices in use now or in the future.

17. Terms and Conditions of Sale
These terms and conditions apply, along with the rest of the Terms and Conditions stated above, when you purchase goods and/or services from Slap the Goon through the Slap the Goon website.

SHIPPING

Our t-shirts are shipped immediately if they are in stock. Otherwise they will need to be printed. This can be a further 10 working days from time of order to get printed. This again can be subject to supply from third party sources. Namely T-shirt suppliers.
We use Australia Post for our domestic deliveries and Australian “Air Mail International” for our international deliveries.

Domestic orders usually take 2-3 working days from the time they are posted. International orders usually take 7-9 days from the day they are posted. Note that this is from the day they are posted. Every effort will be made to get your order to you as soon as we can.

Be aware that each country has its own rules and regulations as to the processing of packages and parcels coming into that particular country. Any delay caused by these regulations is totally out of our control.

HOW MUCH DOES SHIPPING AND HANDLING COST?

All shipping and handling costs are dependent on how many items are purchased and more to the point the total weight of the purchase.
For the domestic Australian market shipping will cost between $6.40 and $12.00 for up to 5 items and approximately $3.00 per item there after. You will have to proceed through the shopping cart to get the exact price as different combinations of order are all of varying weight.

For international orders, you will have to proceed through the shopping cart to see the shipping and handling costs. Once again prices vary between different countries depending on the weight that you will be long asleep before I finish explaining it to you. Be warmed by the fact all it is in Australian Dollars. Pretty much everyone gets a good rate against us.
o All our prices listed here are in Australian dollars. Your final cost will be presented to you in Australian dollars.
o NB. Some countries charge additional import duties, customs duties and carrier fees depending on what type of product you are importing. These fees are totally out of our control thus we take no responsibility for their incursion. Please check with your countries import, postal or customs departments if you have any concerns in this area. This is usually a light hearted and fun experience.

Do I get a receipt?
When you submit your order for purchase, we will confirm your order with an order receipt screen. This screen includes a receipt number which you should retain should you need to contact us concerning your order. HOW LONG WILL IT TAKE TO RECEIVE MY ORDER?

Orders being delivered to an address within Australia will arrive within 8 -10 working days after the day of purchase.
Orders being delivered to an address outside of Australia will take up to 10 days longer. Keep in mind that orders often arrive before this and are dependent on where in our printing/shipping calendar your order is placed. If you have received a shipping order confirmation via email then your order is on its way.
o Please note that different countries have different customs and Slap the Goon cannot be held responsible for variance in delivery resulting from individual customs processes.

SECURITY

How secure is my information?
Slap the Goon is aware of the concerns that you may have with the security of using your credit cards to purchase products over the Internet. To protect your data and privacy, we automatically encrypt your personal information and credit card data using Secure Sockets Layer (”SSL”) software. SSL is the industry standard and among the best software available today for secure online commerce transactions. It encrypts all of your personal information, including credit card number, name, and address, so that it cannot be read as the information travels over the Internet.

Is my information protected and safe?

Slap the Goon offers you peace of mind for the security of your information for online transactions. We employ 3rd party encryption software supplied by Geotrust. Geotrust deliver a total security package in which your transactions are safeguarded by 256 bit SSL encryption. Slap the Goon has been validated by Geotrust as a trusted commercial entity for conducting online transactions using the Geotrust certification. Slap the Goon is unable to guard against fraudulent illegal behaviour in which 3rd parties use stolen information to conduct transactions.

The only time we retain any information is when you become a member of Slap the Goon. This doesn’t include your credit card information though. The information that you share with Slap the Goon is never shared with any 3rd party.

GST

Is GST included?
No. Unless expressly stated otherwise, all prices displayed on the Slap the Goon website do not include Goods and Services Tax (GST). Overseas orders are exempt from GST.

WHAT IF I WANT TO RETURN A PRODUCT?

That’s cool with us provided you adhere to the guidelines as listed:
• Notification of all returns must be made within 60 days of purchase to be accepted.
• The returned product must be in the exact same condition as when purchased. Unworn and unwashed. This is at the discretion of Slap the Goon.
• Please fill out the return form on the back of your invoice that you received in your delivery.
• Returns will be made for refund only.
• If you received an incorrect item or it has a defect, Slap the Goon will reimburse the cost of shipping. Postage costs for all other returns are the responsibility of the customer

PAYMENT

Payment will be considered received once the amount paid by you is received by Slap the Goon in immediately available funds. Slap the Goon reserves the right to cancel any order or delivery until payment is received.

RISK AND DAMAGE

All items purchased from the Slap the Goon website are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier and Slap the Goon accepts no responsibility for any loss or damage of goods occurring in transit.

CHANGES IN TERMS

Product prices, shipping/delivery costs, types of shipping methods, and other terms and conditions of sale, are subject to change without prior notice. Publishing information about a product and/or service on the Slap the Goon site does not ensure its availability.
